New Jersey Man Arrested in Connection with Parsippany Burglary
A 26-year-old Pompton Plains man has been arrested after allegedly stealing jewelry from a New Jersey home. According to a news report in The Star Ledger, the alleged burglary occurred in the Troy section of Parsippany. Officials suspect the man broke into a home, stole jewelry, fled the scene, eluded police, and hid inside a wooden shed. Officials found him in possession of the jewelry and charged him with receiving stolen property, criminal mischief, resisting arrest, burglary, theft, and aggravated assault.
Under N.J.S.A. 2C: 18-2, a person “is guilty of burglary if, with purpose to commit an offense therein he: (1) Enters a research facility, structure, or a separately secured or occupied portion thereof unless the structure was at the time open to the public or the actor is licensed or privileged to enter; or (2) Surreptitiously remains in a research facility, structure, or a separately secured or occupied portion thereof knowing that he is not licensed or privileged to do so."
One of the main distinctions between burglary and theft is entry into a building or structure. Burglary is typically a third-degree crime in New Jersey, but it can escalate to a second-degree crime if a forced entry into the structure was made with the intent to commit an assault crime. Charges may also escalate if anyone is injured during the commission of the burglary. The penalties for this type of crime are severe and can result in prolonged periods of incarceration and heavy fines.
